[ A2P ] Step 5: Create or Update Terms of Service

Please note that this is not comprehensive and you should therefore always consult with your own legal counsel before publishing to ensure they meet the needs of your business and jurisdiction.
The "Terms of Service" need to:
- Show company name for branding in header.
- Must not include terms like "share," "sell," "affiliate," or "third-party" when they imply selling or sharing the leads' information with a third party, unless explicitly allowed.
- Include these 6 bullet points ( Enclosed is a copy of the boilerplate terms of service covering minimum requirements from the carriers ):
Your Terms of Service must identify the sender, provide opt‑out and support instructions, disclose frequency, and reference your Privacy Policy. Ensure the following clauses are included:
- TnC: Business Identity Clause
- Clearly insert your business name and a brief description of the messages users can expect. This clause gives users an idea of who you are and what you do.[ i.e. This campaign sends SMS Notifications, Alerts & Occasional Marketing Communication to customers who have opted in to receive SMS notifications from [insert business name.]
- TnC: Opt-Out & Support Mechanisms
- This must cover how users can opt out of messaging and explain how they can get support.
- You can cancel the SMS service at any time. Just text "STOP" to the [Phone Number]. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

- TnC: Carrier Liability Clause
- Carriers are not liable for delayed or undelivered messages.
- TnC: Message Frequency Clause
- As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive [message frequency]. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
- TnC: Privacy Policy Link
- You must have a cross-link to your privacy policy within the Terms of Service.

Example SMS Messaging Terms & Compliance
- Program Description: This messaging program sends appointment confirmation and reminder messages to customers who have booked an appointment with ABC Business through our website at ABCBusiness.com, or via our scheduling forms, and have explicitly opted in to receive SMS notifications. The opt-in is collected via web forms with dedicated checkboxes for SMS consent. Messages include:
- Appointment scheduling confirmations
- Appointment reminders
- Rescheduling updates
- Customer support communications
- Care coordination and follow-up (where appropriate)
- Service updates, clinic information, and operational notices
- Marketing or promotional messages about services, events, or special offers (if you opt in)
